Social Security

  • Are you planning to apply for Social Security Disability Insurance (SSDI) or Supplemental Security Insurance (SSI) because of a disability?
  • Have you already applied, only to have your claim denied?
  • Are you having trouble making ends meet because your disability keeps you from working?

Applying for Social Security Disability benefits, especially for those who aren’t familiar with the process, is frustrating. Initial claims are often denied and what may (or may not) be considered a disability that qualifies you for benefits is far from clear.

For individuals who are having trouble making ends meet because of lost income or are coping with the sudden inability to do what they once loved, the stress and anxiety associated with applying for Social Security Disability is unnecessary and overwhelming.

Attorney Walter T. Radulski has helped many individuals find peace of mind from the frustration and anxiety involved in applying for SSDI and SSI benefits.

Having helped many applicants, Attorney Walter T. Radulski understands the proof you need to secure the benefits you deserve. More importantly, Attorney Walter T. Radulski knows the process involved in defending your right to receive them.

Medical Malpractice

Medical malpractice is the professional negligence of a doctor, dentist, hospital, nurse or other health care professional. A bad result due to the care and treatment of a doctor does not automatically mean that malpractice has occurred. Malpractice occurs when a health care professional negligently or unintentionally fails to follow commonly accepted or acknowledged standards of medical care. If the doctor’s deviation from the standard of care causes death or injury, a medical malpractice case may exist. A couple examples of a doctor’s deviation from the standard of care are:

  • Failure to timely diagnose breast cancer.
  • Failure to provide appropriate adjuvant therapy, that is, chemotherapy and/or hormonal therapy, to prevent the recurrence of breast, lung or colon cancers.

In Massachusetts, the majority of medical malpractice jury verdicts result in a verdict in favor of the doctor. This statistic demonstrates how difficult it is to prevail in a medical malpractice case. Therefore, your selection of a medical malpractice attorney could mean the difference between collecting monetary compensation for your injuries or not. Attorney Walter T. Radulski is experienced in evaluating potential medical malpractice cases. If you believe you have been harmed by the medical negligence of a health care provider, please call Attorney Walter T. Radulski at 978-458-9118 for an appointment or email the office.

Wrongful Death

“Wrongful death” is defined as a death caused by the wrongful act of another. The wrongful act serves as a basis for a lawsuit to recover monetary damages on behalf of the decedent’s heirs. The wrongful act can occur due to numerous events including, but not limited to:

  • Auto Accidents
  • Workers’ Compensation
  • Drunk Driving
  • Slip and Fall Injuries
  • Medical Malpractice

Attorney Walter T. Radulski is experienced in handling wrongful death cases. Attorney Radulski’s goal is to fully compensate the decedent’s heirs for the death of their loved one. The monetary recovery includes both the economic loss and the emotional loss resulting from the death. Radulski at 978-458-9118 or email the office.

Construction Site Accidents

Construction sites pose many dangers to workers, contractors, and bystanders who are in the area. When an injury occurs, Attorney Walter T. Radulski can help those who have suffered injuries caused by someone else’s negligence.

While many injured workers may be eligible for workers’ compensation benefits, damages such as pain and suffering and other non economic losses are not included under the Massachusetts Workers’ Compensation Act. However, these damages are legally compensable in separate, third party actions arising from a work-related injury. When someone causes a preventable construction accident through negligence, he or she may be liable for the victim’s injuries. The more common construction site injuries that Attorney Walter T. Radulski handles include:

  • Unsafe Working Conditions
  • Falls From Roofs or into Foundations
  • Hazardous Chemicals
  • Ladder Accidents
  • Lifting Equipment Failure
  • Scaffolding Accidents, Falls and Drops
  • Operating Equipment Accidents
  • Welding Accidents
  • Electrical Shock
  • Crane Accidents

Construction site accidents can often result in severe personal injury, such as spinal cord injury, traumatic brain injury, quadriplegia, paraplegia, fractured legs and arms, including broken elbows and ankles, and even death. Due to the severe nature of such injuries, construction site accidents are often the subject of personal injury lawsuits and litigation.

It is important that you contact an attorney as soon as possible so that crucial evidence may be preserved and witnesses may be interviewed while the facts are still fresh in their minds. In serious accidents, experts are retained to solidify theories of liability. By consulting an attorney immediately, you increase your likelihood of receiving the full compensation to which you are entitled.

Attorney Walter T. Radulski is well versed in all aspects of handling construction site personal injury accidents. If you have been injured at a construction site, please call Attorney Walter T. Radulski at 978-458-9118 or email the office.

Slip and Fall Accidents

When a person is injured because of the existence of a dangerous or defective condition, existing at a store, residential home, stairwell, commercial building, parking lot, driveway, mall or restaurant, a premises liability claim may exist. Some of the types of premises liability cases handled by Attorney Walter T. Radulski include, but are not limited to:

  • Dangerous Stairs
  • Ice and Snow Fall-downs
  • Trip and Fall Claims
  • Building Code Violations
  • Slip and Fall Claims
  • Stairs Without Handrails
  • Improper Lighting Claims
  • Improper Building Maintenance
  • Grocery Store Falls

While the owner of a home or business or other property is not automatically responsible whenever someone is injured, they do have a responsibility to inspect the property and maintain it reasonably. Some examples:

  • A grocery store should have a clerk or other employee make regular inspections of the floors to find out whether anything has spilled and clean up any slip hazard before someone gets injured.
  • A landlord renting out apartments should make it a habit to look around the building and make sure all the lights work, the halls and stairs are clean, and the premises are in generally good order.
  • After a snowstorm is over, the company that manages the shopping mall should make sure the walkways are cleared and sanded so that shoppers can get around safely.

When someone is injured because of the negligence of the property owner, it can be difficult to get fair money compensation. Insurance companies and defense lawyers quickly point the finger of blame at the person who fell, saying they should have seen the problem and avoided it.

Hiring experienced legal counsel like Attorney Walter T. Radulski can make all the difference. Please contact Attorney Walter T. Radulski at 978-458-9118 or email the office if you are seriously injured because of a dangerous or defective condition existing on a premises.

Dog Bite Incidents

Under Massachusetts law every dog is not entitled to one bite. The owner or keeper of a dog is strictly liable for his or her dog, even if it is the first time the dog has injured someone. As long as the injured victim was not committing a trespass or other tort or was not teasing, tormenting or abusing the dog, then the keeper or owner of the dog is liable for the injury. Compensation for a dog bite includes payment for medical expenses, pain and suffering, mental anguish, fear and scarring.

Attorney Walter T. Radulski has handled claims where dogs have tripped people, knocked people down and have attacked and bitten people. Attorney Walter T. Radulski is very experienced in representing victims of dog injuries. If you have been seriously injured by a dog, please contact Attorney Walter T. Radulski at 978-458-9118 or email the office.

Product Liability

When a product malfunctions due to a defect and causes serious personal injury, the law requires the manufacturer, wholesaler or retailer of the product to bear the losses caused by the defect in the product.

There are three main categories designated for defective products which may result in product liability claims:

  • Design Defects – flaws in the product’s conceptual design
  • Manufacturing Defects – specific defects which occur during the manufacture of the product
  • Defects in Marketing – improper instructions or failures to elucidate consumers of potential and latent dangers in the product

In product liability cases the product itself is the most important evidence and the product should be stored in a secure location and kept in your custody if possible. It will be necessary for engineers and other expert witnesses to thoroughly evaluate the products.

If you have experienced personal injury due to a defective product, please call Attorney Walter T. Radulski at 978-458-9118 or email the office.
